I may have missed this..
can anyone assist me?

I am looking for a way to turn legato on and off during performance..
using a keyswitch, midi cc number or pedal...

I need to be able to do this on the fly with both RS and LPC

Playing legato on a guitar means using hammerons/pulloffs or slides. The keyswitches for these are labeled "Hammeron (legato)" and "Slide (legato)", so assign those keyswitches to separate notes on your keyboard and then either trigger them in realtime (tricky to time right unless you play all notes with hammers/pulls and slides, which aint too realistic) or add them in the midi editor after the fact. When triggering either of these, both consecutive notes you play must fall into the range assigned (ie. you can't play legato with notes 5 semitones apart if you have the keyswitch set to "2"). I wouldn't set that value too high, as a guitarist can't realistically play hammerons on notes ten semitones apart, if you know what I mean.

so you are saying that the big "legato" button should be switched off and I should use key switches?

Legato (big button) allows to play several notes (scale type) without attacks as if played on guitar with only first note picked and others tapped on the same string with left hand fingers

which leads me back to the original question: why is this button not switchable via MIDI CC?
